Agreement
These Terms govern your use of Avooch: AI Talk by Voice (the “App”) provided by AIVEI LLP (“AIWAY”, “we”). By installing or using the App you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the App.
Eligibility
You must be at least 13 years old to use the App. If you are under the age of majority where you live, you may use the App only with the involvement of a parent or guardian.
License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the App on devices you own or control, under these Terms and the rules of the App Store or Google Play. You may not copy, modify, reverse engineer, resell or use the App to build a competing product.
Subscriptions and purchases
Some features require a paid subscription or an in-app purchase. Prices are shown in the App before you buy. Payment is charged to your Apple ID or Google Play account at confirmation of purchase. Subscriptions renew automatically unless auto-renew is turned off at least 24 hours before the end of the current period; your account is charged for renewal within 24 hours before the period ends. If a free trial is offered, any unused part of it is forfeited when you buy a subscription. You can manage and cancel subscriptions in your App Store or Google Play account settings. Refunds are handled by Apple or Google under their policies.
AI-generated content
The App uses artificial intelligence to generate content. Output can be inaccurate, incomplete or unexpected and is provided for informational and entertainment purposes only. It is not professional advice. You are responsible for how you use the output and for checking it before relying on it.
Acceptable use
Do not use the App to create or share content that is illegal, harmful, hateful, harassing, sexual content involving minors, content that infringes others’ rights, or content that impersonates real people. Do not attempt to bypass safety filters or misuse the service. We may limit or suspend access if these rules are broken.
Your content
You keep the rights you have in the content you submit. You give us a limited license to process it only to operate the App for you. Subject to applicable law and the terms of our AI providers, you may use the output you generate.
Availability
We work to keep the App running, but it is provided “as is” and “as available”. We may change, suspend or discontinue features at any time.
Limitation of liability
To the maximum extent permitted by law, AIWAY is not liable for indirect, incidental or consequential damages arising from your use of the App. Our total liability for any claim is limited to the amount you paid for the App in the 12 months before the claim. Nothing in these Terms limits rights you have under consumer protection law that cannot be waived.
Apple-specific terms
If you downloaded the App from the Apple App Store, these Terms are between you and AIWAY, not Apple. Apple is not responsible for the App or its content, has no obligation to provide support, and is a third-party beneficiary of these Terms. Apple’s Standard EULA also applies to the extent it does not conflict with these Terms.
Governing law
These Terms are governed by the laws of the Republic of Kazakhstan, without regard to conflict-of-law rules, unless mandatory law of your country of residence provides otherwise. We may update these Terms; continued use of the App after an update means you accept the new version.
